    Public Prosecutor Will Not Appeal 4-Year Jail Sentence For Joshua Robinson: AGC

    Following a “careful” review, the Public Prosecutor has decided not to appeal against the four-year jail term imposed on convicted sexual predator Joshua Robinson last week, noting that the punishment he got was broadly in line with relevant past cases’.

    In a statement on Wednesday (March 8), the Attorney-General’s Chambers (AGC) added that while some have called for caning to be imposed on Robinson, the offences he was charged with did not allow the court to do so.

    The AGC also said: “In discharging our duties, we do not differentiate between Singaporeans and non-Singaporeans.”

    The American mixed-martial arts instructor was sentenced to four years’ jail last week for a myriad offences, ranging from sexual penetration of two 15-year-olds to showing an obscene film to a six-year-old girl.

    Following his sentencing, the case attracted widespread public attention, with many questioning why Robinson was not punished more severely – including an online petition being started on Sunday calling for a harsher sentence. More than 26,000 people, including the father of the six-year-old girl affected, have signed the petition, as of Wednesday afternoon.

    In 2015, Robinson contacted a 15-year-old girl through social media repeatedly, and exchanged numbers with her. He instructed the girl to wear her school uniform during their first meeting, where they went to his apartment along Upper Circular Road. There, he filmed them engaging in sexual acts.

    After the girl made a police report, the police found 5,902 obscene films in Robinson’s apartment, of which 321 featured child pornography – the largest stash found on an individual. The children in these videos were between the ages of two and 16.

    In its statement, the AGC said that by getting Robinson, 39, to plead guilty instead of claim trial, his three young victims were spared the ordeal of having to testify in court.

    It had asked for four to five years’ jail to be imposed, after taking into account, among other things, “the fact that by securing a guilty plea, the three young victims would be spared the trauma of having to testify and be cross-examined in a trial”.

    The AGC also addressed public comments that Robinson should have been charged with rape, statutory rape or outrage of modesty, and be subject to caning. It explained that statutory rape only applies to victims who have not turned 14, which was not the case in Robinson’s offences. And because both girls had consented to these sexual acts, an offence of rape could not be pressed against Robinson.

    The most serious offence that Robinson had committed was sexual penetration of a minor under 16 years old, and that did not provide for caning, the AGC added.

    AGC said that it would be discussing with the Ministry of Law whether the relevant legislation should be reviewed to enhance sentencing for some of the offences.

    American Sexual Predator Preyed On Young Teenage Girls In Singapore,

    Harbouring a fetish for young girls, a 39-year-old man used social media platforms to lure victims, then secretly filmed them engaging in sexual acts with him to add to his stash of child pornography videos.

    Joshua Robinson, who successfully preyed on two 15-year-olds between September 2013 and June 2015, was on Thursday (March 2) sentenced to four years’ jail, as the judge described him as a sexual predator.

    When the law caught up with Robinson, officers who raided his apartment found 5,902 obscene films, of which 321 videos featured children between the ages of 2 and 16. This is believed to be the largest child pornography video collection seized from one person in Singapore.

    Robinson, a mixed-martial arts instructor, faced 29 charges in total, ranging from sexual penetration of a minor to making an obscene film. The prosecution proceeded with nine of these charges, with the remaining taken into consideration during sentencing.

    In March 2015, the American used the pseudonym “Tristan” to contact a 15-year-old girl on a social media website. He told her she looked good, and asked for more photographs of herself. The conversation ended after she declined his request.

    Months later, she posted a drawing online, and he contacted her again to praise her artwork. They exchanged numbers thereafter.

    He claimed that he was 27, and told the girl that he had a fetish for young girls in uniform.

    “I have wanted to find as young as possible. I think 13 would be ultimate. But 15 is youngest,” he said in a text message to her.

    When she said that she was insecure about her weight, he told her that he accepted the fact. “He took full advantage of her own insecurity about her body image … so that he would get emotionally closer to the victim,” said Deputy Public Prosecutor Nicholas Lai.

    During the third week of June, Robinson said that there was no point in chatting online unless they met up. He instructed her to wear her school uniform without underwear and met her at Clarke Quay MRT Station on the morning of June 23, before they went to his apartment at Upper Circular Road. In the apartment, he filmed the sexual acts that he performed on her.

    “As (she) was engaged in sexual activity with the accused, she noticed that he was using his handphone at all times. She was unaware of what he was doing at first and assumed he was just ‘multi-tasking’ on his handphone,” said DPP Lai.

    After the meet-up, she had a mental breakdown and filed a police report.

    During investigations, the police found 12 obscene videos of Robinson with another 15-year-old girl on his laptop. It turned out that he got to know her from a dating website in 2013.

    They had at least three sexual encounters between September 2013 and September 2014.

    While Robinson was on police bail, he showed a six-year-old girl an obscene video of himself at a Brazilian Jiu Jitsu gym at Peace Centre. On July 27, 2015, the girl had accompanied her father to the gym, and as he trained, Robinson approached her to show her the obscene video.

    DPP Lai described Robinson as a prowler on the internet who sexually groomed and morally corrupted his young victims.

    “The victims were 15 years old when the accused, who was two-and-a-half times their age at the material time, coaxed them into performing sexual acts with him… From the get go, the accused had preyed on the victims’ youth, naivety and vulnerability to satiate his sexual lust,” said the prosecutor.

    Agreeing with the prosecution, District Judge Crystal Ong said that Robinson demonstrated a propensity for committing sexual acts with young girls, although a psychiatrist ruled out any mental illness such as pedophilia.

    Defence lawyer Mervyn Tan acknowledged that it was wrong to use social media to “lure and attract” victims. But he also argued that the films in Robinson’s possession were for private consumption, and not meant for circulation.

    The first Singaporean to be convicted of organising a commercial sex tour overseas was allowed on Monday to revoke his bail pending his sentence next month.

    Before he was led away from the dock to be remanded, Chan Chun Hong turned around to gesture to his parents seated in the 11public gallery that he was going in.

    District Judge Siva Shanmugam will sentence Chan on March 23 on 12 of 145 charges – seven of distributing obscene materials, one of making travel plans for an undercover cop to have commercial sex outside Singapore, three of distributing information to promote conduct of commercial sex with a minor, and one of having obscene films at his Yishun Ring Road home.

    The 31-year-old Nanyang Technological University civil engineering graduate was serving in the Singapore Armed Forces at the time of the distribution of obscene materials offences totalling 135 committed over a one-year period in 2011 and 2012.

    He had joined a major insurance company as a financial consultant when he was nabbed at Changi Airport on March 1 last year.

    Police established his identity after receiving information from the Federal Bureau of Investigation (FBI) in 2013 that a male Singaporean was distributing child pornography materials worldwide.

    The information had also revealed that there were e-mail exchanges between the Singaporean and other users which suggested that Chan had engaged in child sex tourism.

    Chan’s lawyer Rajan Nair said in mitigation his client had a depressive episode following his late Taiwanese fiancee’s illness from womb cancer in 2009. In 2010, he took unpaid leave from the SAF to live and take care of her in Taiwan until her death that year.

    Chan, he said, has always been a person of good character and held in good esteem and standing by his peers and colleagues.

    Diagnosed with paedophilia, Chan intends to undergo treatment upon his release from prison, said the lawyer.

    Mr Nair said it was the undercover cop “Teo Dennis” who had initiated contact with Chan and started asking him about “young girls”. Chan did not seek out persons for whom he could organised commercial sex tours.

    He said Chan had never had sex with a minor. It was most likely that he would not have arranged for the trip for Teo Dennis and himself or anyone else to go overseas for commercial sex with minors if the latter had not instigated him. It was very likely that Chan would have cancelled the intended trip in April last year as he was busy with his work.

    “The only silver lining in this whole episode is that Mr Chan has been forced to confront his problem and is now finally able to courageously take steps to ensure that he does not suffer a relapse,” said Mr Nair.

    Deputy Public Prosecutor Yang Ziliang said Chan claims he had never had sex with a minor and that he did not have any experience with the Cambodia prostitution scene. Yet he has consistently informed other parties otherwise.

    He said Chan has failed to show he is genuinely remorseful and contrite for his wrongdoing as he has tried to minimize his misconduct at every stage of the investigations and prosecution.

    A Singapore man was Friday convicted of organising a commercial sex tour overseas and distributing information intended to promote paid sex with a minor outside the city.

    Chan Chun Hong pleaded guilty to seven counts of transmitting obscene material by electronic means, one count of making travel plans, three counts of distributing information to promote commercial sex, and one of having obscene films, The Straits Times reported.

    Another 133 charges, mostly for transmitting obscene material, will be considered when he is sentenced.

    Following a tip-off from the US Federal Bureau of Investigation (FBI) in 2013, Chan, also known as Chris, was arrested at Singapore’s Changi Airport March 1, 2014.

    Information received suggested he had engaged in child sex tourism in countries such as Indonesia, Cambodia and the Philippines.

    Investigations showed that he saved his collection of child pornography in his portable hard disk and transmitted it to other users in exchange for new material between Dec 2, 2011 and Sep 6, 2012.

    The obscene photographs and videos included naked or half-naked young girls in various sexual acts and poses. Some appeared to be as young as two.

    The prosecution is seeking a jail sentence of at least six years for Chan, whose lawyer Rajan Nair asked that the case be adjourned to Feb 16.

    The maximum penalty for taking a tour outside Singapore for commercial sex with a minor is 10 years in jail and a fine on each charge.
