    Mat Jailed For Having Sex With Underage Girlfriend Even When She Was 7 Months Pregnant

    Despite being told by his 15-year-old girlfriend that she was pregnant, Muhammad Nur Shafiq Mohamed Noor, 22, dismissed her fears and continued to have sex with her, a district court heard.

    This went on even when she was about seven months pregnant.

    On Thursday (May 11), Nur Shafiq was jailed for 18 months after he pleaded guilty to three of 13 charges of sexual penetration of a minor between November 2015 and May last year.

    Deputy Public Prosecutor Kavita Uthrapathy said the victim and Nur Shafiq became acquainted through mutual friends towards the end of October 2015. They subsequently became a couple.

    On Nov 4 and 5 that year, he said he wanted to have sex with her but she rejected him. She had told him she was 15.

    But he persisted and she gave in when they met again on Nov 10. He took her to an HDB block in New Upper Changi Road where he had unprotected sex with her at a staircase landing. They had sex again the next day at the same place.

    Sometime during end-January 2016, she missed her period and suspected she was pregnant. She told Nur Shafiq but he said she was just “late”, and continued to have unprotected sex with her.

    Feeling unsettled, she did a urine test in early February which confirmed her pregnancy.

    Nur Shafiq did not believe she was pregnant even when she showed him the pregnancy test stick.

    Although she did another test with the same result, he still refused to believe her and continued to have sex with her.

    On March 28, the teen met him and his mother at a clinic where her pregnancy was confirmed. Although she agreed with Nur Shafiq’s mother to have an abortion, the doctor at the clinic said she had to go to KK Women’s and Children’s Hospital (KKH) as she was in an advanced stage of pregnancy.

    She was admitted to KKH on April 8 where it was confirmed that she was about 24 weeks pregnant.

    About a month later, Nur Shafiq again asked to have sex with the girl while walking around Novena Square. She was then about seven months pregnant.

    He took her to the basement carpark of the nearby Mount Elizabeth Hospital and had unprotected sex with her.

    Two months later, the victim gave birth to a girl, who has been placed on foster care as the teen is unable to care for her child.

    DPP Kavita had sought 10 months’ jail on each of the charges in view of the aggravating factors.

    District Judge Wong Li Tein sentenced him to nine months’ jail on each charge, and ordered two sentences to run consecutively. She said the only mitigating factor was that he was young.

    The maximum penalty for sexual penetration of a person under 16 years old is 10 years’ jail and a fine.

    This young 14 year old boy impregnated his 13 year old girlfriend, earlier this year. His girlfriend is now 5 months pregnant and the authorities have got involved.

    Instead of obeying the gag order and settling the matter with the authorities, he made a public post on the Ministry of Social and Family Development’s facebook page, ranting about how the Ministry had taken his girlfriend from him. He was furious that the MSF had sent his girlfriend to the Girls’ Home and he insisted that he can be a responsible 14 year old father! He is also an underage smoker and he has consumed alcohol too. There are many such photos on his facebook page. As a result of Wei Jian not complying with the gag order, by now many Singaporeans have already shared his post through the social media.

    Here is the text of what he posted on the MSF facebook page:

    Joke on how effective you are, msf. Ministry of Social and Family? Then what are you doing to break up our small family. I just wanted my Girlfriend to be back with me, and you just snatch her away from me. Not answering any calls from us, even my girlfriend’s Mother. Even my girlfriend’s Mother cant contact till my Girlfriend. Can’t even get to know where she is until the fourth day.

    My Girlfriend is only 13 years old, yet you bring her to court without any parents consent. Is this how singapore’s law or police do their job? We can’t even lodge a report just to know where she is. My Girlfriend is already 5 months pregnant, and you put her inside girls home. What if she was bullied inside? What can you do? You can’t be watching over her for 24/7 every single day.

    I’m the one who was at fault, but why did you charge on only my Girlfriend? MY GIRLFRIEND IS PREGNANT AND YOU PUT HER INSIDE GIRLS HOME. You said it was a better place for her? It wasn’t, she need more care.

    Furthermore, I can’t even attend her court hearing, she would be afraid because she is alone and she is only 13 years old. She called her mum saying she wanted to go home, but msf is not doing anything. MSF told us she could be out after 1 month, but she isn’t out now. Why? I’m the Father of the child, I will bear all responsibility of the wrongs I did, because I’m a guy, but you took a 5 months pregnant woman away, putting her in such a dangerous place, without any care. Me and my Mother couldn’t get to see her at all, even her court hearing, we can’t be there.

    A full-time national serviceman who had sex with a girl under 16 years old while on probation for similar offences was sentenced to reformative training on Monday.

    Gil Dominic Barbosa Rojas, 20, a Singapore permanent resident, had admitted to two counts of having sex with a 15-year-old girl on April 1 and 8 this year, and with a 13-year-old girl sometime between January and February last year.

    A Community Court heard last month that Rojas, a Filipino, came to know the 15-year-old girl on Facebook in June last year. They exchanged contact numbers and started to communicate over the phone.

    They eventually met at his home at Anchorvale Road on April 1. He asked her to be his girlfriend, to which she agreed.

    They had consensual and unprotected sex in his bedroom.

    A week later, she did not go to school and instead, met Rojas at his home. They had sex again.

    The victim’s mother was checking her Facebook account when she saw Rojas’ messages to her and began questioning her. The victim then admitted that she had sex with Rojas.

    The mother lodged a police report on April 15.

    Further investigation showed that Rojas and the second victim, then 13, befriended each other through a WhatsApp group chat. They entered into a boyfriend-girlfriend relationship the same month.

    Subsequently, he brought her to his home, where he had unprotected sex with her. He was then 18.

    Rojas was placed on 24 months’ split probation in October last year after pleading guilty to three underage sex offences and one of committing an indecent act.

    For the latest cases, a progress report stated that Rojas lacked remorse, has a high risk of offending, and requires supervision in a closed and structured environment.

    Deputy Public Prosecutor Krystle Chiang said Rojas had justified his offences by saying the victims told him they were of legal age, that is, 16 years.

    District Judge Lim Keng Yeow said despite having faced 16 charges previously and placed on probation, it was clear from Rojas’ conduct that he was not suitable for probation but needed a different form of rehabilitation. He sentenced him to a stint in the Reformative Training Centre (RTC).

    Those serving time in RTC stay between 18 months and three years behind bars, and undergo a strict regimen that includes foot drills and counselling.

    More teenagers are becoming sexually active – with an increasing number thinking that it is normal for them to have sex, social workers say.

    Figures from the State Courts show a steady growth in the number of cases of sex with a minor – that is, sex with a girl under 16, which is a crime even if she gives her consent.

    Last year, there were 76 cases of the offence, down from 89 in 2013, but still an increase from 63 in 2012 and 36 in 2011.

    At the Youth Court – which deals with children and youth under 16 years – there were four cases of youths charged last year with having sex with another minor, and five cases of assault with the intent of molest.

    Social workers told The Straits Times that young people are typically referred to counsellors for behavioural problems but, during counselling, they sometimes open up on their sexual experiences.

    Ms Lena Teo, assistant director of counselling at the Children-at-Risk Empowerment Association (Care Singapore), said: “I’ve seen roughly 20 per cent more underage sex cases over the years. Nowadays, teens are more tech-savvy and some lack parental control. They are more experimental because of curiosity and hormones raging at that age. It could also be peer pressure.”

    Mr Lam Wai Mun, a senior counsellor at Touch Cyber Wellness, noted that underage sex is a common issue.

    “Some in primary school are also watching pornography, which is damaging because they form unhealthy perceptions,” he said.

    The younger generation is also more open to having sex at an early age, according to Mr Trevor Xie, former director of Children’s Wishing Well, a charity for underprivileged children and youth.

    “They don’t see losing their virginity as a loss. They see sexual experience as a gain,” he said.

    Mr Xie added that they are usually willing parties, and are looking for love.

    Ms Rachel Lee, senior assistant director of Fei Yue Family Service Centres, said the Internet has an impact on their views on sex as they may be exposed to “undesirable material” online.

    “In the last five years or so, there has been an increase in such cases. There are those who engage in underage sex but are just not caught yet,” said Ms Lee.

    “This affects their studies and some may get pregnant and drop out of school,” she said, adding that “a lot of them are not ready to take on the responsibility”.

    Experts said parents play an important part in ensuring that their children grow up with the right values.

    Ms Gracia Goh, head of the Singapore Children’s Society’s youth centre in Jurong, advised parents to talk to their children about sex and take note of any inappropriate behaviour. Parents should also look for “teachable moments” when they can have discussions with their children about what they are watching or hearing, added Ms Goh.

    If necessary, they can block access to websites with sexually explicit material.

    Dr Adrian Wang, a psychiatrist in private practice, advised: “Have a close and healthy relationship with your children, so that they’ll feel comfortable asking you questions, and you’ll know who their friends are and what they’ve been up to.

    “Peer influence is a powerful thing, and many kids are clever enough to go under the radar and hide their activities from you.”

    SEORANG lelaki berusia 24 tahun dijatuhi hukuman penjara tujuh bulan di penjara semalam selepas dia mengaku bersalah melakukan seks oral dengan seorang budak perempuan bawah umur.

    Mahkamah diberitahu, Muhammad Hairuniezam Marwi, yang berusia 22 tahun ketika melakukan perbuatan itu pada 9 Julai 2012, nampak rakannya melakukan seks dengan budak perempuan berusia 15 tahun itu di belakang tembok di *Scape Skate Park di Somerset Road, dan meminta budak itu melakukan seks mulut dengannya.

    Hairuniezam, yang merupakan seorang jurutari, boleh dipenjara sehingga 10 tahun dan/atau didenda bagi kesalahan tersebut.

    Timbalan Pendakwa Raya, Cik Elizabeth Chua, memberitahu mahkamah bahawa gadis itu menyertai satu kumpulan termasuk Hairuniezam dan rakannya, Ryan Nicholas Shah, 27 tahun, di *Scape Skate Park pada petang itu.

    Kumpulan itu mula menikmati minuman koktel beralkohol. Mangsa minum beberapa gelas dan mula merasa mabuk.

    Kira-kira 11 malam, Shah dan budak perempuan itu pergi ke belakang tembok untuk membuang air kecil.

    Selepas beberapa ketika, Hairuniezam pergi untuk memeriksa mereka kerana mereka tidak pulang.

    Dia dapati pasangan itu sedang mengadakan seks di belakang salah satu tembok.

    Dia menemui budak perempuan itu dan memintanya melakukan seks mulut dan mangsa akur.

    Selepas tengah malam, kedua-dua lelaki menghantar mangsa pulang dengan menaiki teksi.

    Ibu mangsa berasa bimbang setelah melihat mereka.

    Beliau kemudian dapati anaknya terbaring atas lantai di depan rumah.

    Mangsa kemudian memberitahu ibunya bahawa beliau telah melakukan seks dengan kedua-dua lelaki itu.

    Ibu bapanya kemudian menghubungi polis.

    Darah dan contoh air kencing mangsa dianalisa dan didapati mengandungi ethanol yang tinggi.

    Shah, yang telah didakwa kerana melakukan seks dengan budak perempuan itu, akan kembali ke mahkamah pada 24 Februari ini untuk kesnya didengar lagi.
