    Independent Preacher: Archaic Jurisprudence Behind Swine Kerfuffle

    KUALA LUMPUR, Feb 9 ― Swine products are only “haram”, or forbidden, when ingested, according to all Muslim schools of jurisprudence except for the Shafie school widely practised in Malaysia, independent preacher Wan Ji Wan Hussin said today.

    The PKR Islamic Council leader said “archaic jurisprudence” has resulted in the sensitivity regarding the issue, and that it would never have happened if there was more openness in interpreting Islamic laws.

    “All school of jurisprudence except Shafie states that pigs are only haram when eaten. When touched, not haram,” Wan Ji said in a public post on his Facebook profile.

    “This thing became sensitive, only because of the archaicness of jurisprudence. Therefore, the issue of swine leather shoes is not an issue in societies with jurisprudence openness. The ones where it is sensitive, is with societies that are archaic in jurisprudence.”

    Muslims are strictly forbidden from eating pork and products derived from pork, with the origin coming from a Quranic verse 2:173 which prohibits “dead animals, blood, the flesh of swine, and that which has been dedicated to other than Allah”.

    The same verse states that there is no sin for those who do so when forced by necessity.

    In Malaysia, only the Sunni denomination of Islam and its Shafie school of jurisprudence are considered official.

    Wan Ji, however, contended that despite the claim that Malaysia follows the Shafie school, it does not follow that school in other matters, such as the issue of zakat, or alms, where the Shafie school specifies that it is invalid to use cash for alms.

    For example, the Shafie school specifies that the “zakat fitrah” paid during the holy Ramadan month, should be made in the form of staple food within the specific community.

    The national fatwa council has since decreed in 2003 that the payment can be made with cash equivalent to a specified value of local rice.

    “My reminder is for Malaysia to not play sentiments on these issues. Instead, they have to educate the society on the openness, not the archaicness, of jurisprudence,” said Wan Ji.

    “Parties who brought this issue up, I remind them that their actions will cause non-Muslims to hate Islam, they will be cynical towards Islam.”

    National news agency Bernama reported Tuesday Domestic Trade, Cooperatives and Consumerism Minister Datuk Seri Hamzah Zainudin saying that his ministry seized 2,003 paintbrushes made with pig bristles worth almost RM11,000 in a nationwide “crackdown”.

    He reportedly said the brushes were confiscated under the Trade Descriptions (Goods Made from any Part of Pig or Dog) Order 2013, which states that such products must be labelled and separated from other goods.

    Punishments for violations of the minister’s order are RM100,000 fines, three years’ jail or both for individuals, while corporations face fines of up to RM250,000.

    Subsequently, Muslim Consumer Association of Malaysia (PPIM) called for a logo to differentiate items containing pig-derived parts to inform the “not that smart” Muslim consumers.

    Malaysian Authorities Seize Pig-Hair Paint Brushes Following Complaints From Muslims

    KUALA LUMPUR, Malaysia (AP) — Malaysian authorities have seized thousands of paint brushes suspected of containing pig bristles after consumers in this Muslim-majority nation demanded a crackdown, officials said Wednesday.

    Pigs and dogs are considered unclean by many Muslims, who make up some 60 percent of Malaysia’s 30 million people. It is illegal in the country to sell products made from any part of a pig or a dog, unless the goods are labeled and kept separately.

    Zarif Anwar, an enforcement official with the domestic trade and consumer ministry, said that since Tuesday, officials nationwide have been inspecting shops selling paint brushes for art and commercial use.

    He said the brushes seized were not labeled and found to have a different texture from other brushes and frayed ends, signs that they could be made from pig bristles. In some cases, the brushes had a “halal” certification that had expired, he said. The halal tag is issued by an Islamic government body to certify products safe to be used by Muslims.

    The seized brushes will be sent to a lab to be examined, Zarif said.

    “We want to protect consumers and we want traders to be aware of the religious sensitivity involved. This is a big offense,” Zarif told The Associated Press.

    He warned that traders who flout the rule face up to three years in jail, a fine of 100,000 ringgit ($22,522) or both.

    Conservative attitudes have been on the rise in Malaysia. A wide range of products have been certified halal, from mineral water to a newly launched internet browser, to appeal to Muslims.

    The Muslim Consumers Association of Malaysia called for stricter enforcement not just for paint brushes, but for other products as well. An official from the group, Nadzim Johan, said the association also received complaints that culinary brushes used in eateries may also contain pig bristles.

    “The key issue here is about labeling,” he said. “We want Muslim consumers to be forewarned. It’s not fair to deceive them.”

    Malaysia Seeking To Revise Judgment On Pedra Branca Citing New Facts, Singapore Forms Legal Team To Study Challenge

    Malaysia, citing “new facts” discovered in recently declassified British documents, has filed a challenge to the 2008 decision by the International Court of Justice (ICJ) that ruled Pedra Branca to be Singaporean territory.

    Singapore’s Ministry of Foreign Affairs said in response that the Republic is “studying Malaysia’s application and documentation closely”, and has formed a legal team to respond to Malaysia’s challenge.

    The Singapore legal team includes Attorney-General Lucien Wong, former Deputy Prime Minister S Jayakumar, Professor Tommy Koh and former Chief Justice Chan Sek Keong.

    Malaysian Attorney-General Mohamed Apandi Ali filed the application with the ICJ at The Hague on Thursday (Feb 2) over the sovereignty of Pedra Branca, which is located some 24 nautical miles to the east of Singapore. The Republic was alerted overnight through the formal channels of the High Commission and the International Court of Justice.

    “The application was made by Malaysia upon the discovery of some fact of such a nature as to be a decisive factor, which fact was, when the judgment was given, unknown to the Court and also to Malaysia as the party claiming revision,” Mr Apandi said in a statement on Friday.

    He added: “We are also confident that the requirements as stipulated under Article 61 of the Statute of the International Court of Justice have been met in that, inter alia, the application for revision is brought within six months of the discovery of the new fact, and within 10 years of the date of the Judgment.”

    It is early days yet in the court process, with the panel of judges to hear the case yet to be formed. Both sides will have a say in the appointment of the judges, and the number of judges on the panel is yet to be determined.

     

    The Malaysian statement did not disclose details of the “new facts”. TODAY understands that three new facts were submitted. In response to queries from TODAY, Mr Apandi would only say that these were “discovered after the British Government declassified the documents recently”. Asked to identify the specific documents, he said: “Not now…when Singapore is being notified, they will be served with the relevant papers.”

    KUALA LUMPUR: Gara-gara isteri beliau bersalin dalam bas bernama Eagle Express, rakan-rakannya berseloroh, apa kata berikan nama anak lelakinya itu ‘Mohd Eagle’!

    Mujur pemandu bas Eagle Express itu, Muhammad Ikhsan Ismail, 45 tahun, berkata beliau tidak akan menerima ‘saranan’ nakal rakan-rakannya itu dan belum memutuskan nama yang akan diberikan kepada anaknya.

    Menceritakan kejadian pada 18 Januari lalu itu kepada akhbar Harian Metro, beliau berkata apabila isterinya, Noridayu Ali, 29 tahun, rasa sakit hendak bersalin, beliau membawanya menggunakan bas dari rumahnya di Rawang, Selangor, ke Hospital Sungai Buloh.

    Bagaimanapun, isterinya itu bersalin di tempat duduk belakang bas yang dipandunya itu pada 1.45 petang, sebelum sempat tiba di hospital.

    “Saya terpaksa berhentikan bas di tepi jalan bila isteri panggil saya, dan terkejut tengok bayi dah keluar.

    “Kelam kabut saya waktu itu dan terpaksa terus memandu ke bahagian kecemasan walaupun jalan sempit nak masuk dengan bas,” kata Encik Muhammad Ikhsan kepada Harian Metro.

    Menurutnya, beliau lalu membunyikan hon dan memaklumkan isterinya sudah bersalin dalam bas.

    Malah, menurut Harian Metro, gambar isterinya setelah melahirkan bayi lelaki mereka di dalam bas itu menjadi viral di Facebook.

    Encik Muhammad Ikhsan berkata meskipun dilahirkan pada usia tujuh bulan, bayinya yang seberat 2.26 kilogram itu, serta isterinya, dalam keadaan sihat dan selamat.

    Fluff Bakery, kedai kek cawan atau ‘cupcake’ popular Singapura, sudahpun mula menebarkan sayapnya ke Kuala Lumpur. Ini apabila ia melancarkan kedai sementaranya yang pertama di ibu kota Malaysia itu.

    Kesemuanya, Fluff Bakery akan membuka empat kedai sementara itu di sana.

    Bagi kedai sementara yang pertama itu, ia dilancarkan lebih seminggu lalu (14 Jan) dalam satu acara privet. Ia dihadiri para penaja, rakan-rakan dan keluarga. Acara itu berjalan dengan lancar dengan hampir kesemua 450 kek cawan yang dibawa dari Singapura, disapu bersih!

    “Kami sebenarnya tidak percaya dapat respons yang begitu baik. Tetapi Alhamdullilah semuanya baik hingga kami risau jika bekalan kami bawa ke Kuala Lumpur tidak mencukupi,” ujar pemilik bersama Fluff Bakery Mohammad Ashraf Mohammad Alami, 35 tahun.

    RANCANG 4 KEDAI SEMENTARA DI KL

    Kedai sementara yang berlangsung hanya sehari itu adalah yang pertama daripada empat siri yang akan diadakan Fluff Bakery di merata Kuala Lumpur.

    Meskipun kedai sementara yang pertama itu diadakan secara privet, Fluff Bakery menyatakan tiga lagi kedai seumpamanya akan didedahkan kepada orang ramai pada masa yang terdekat.

    “Insyaallah, menjelang bulan Mei nanti kami akan menubuhkan kedai yang tetap di Kuala Lumpur,” kongsi Nursyazanna Syaira Md Suhimi, 29 tahun, pemilik bersama dan ketua pembuat kek Fluff Bakery.

    Pasangan suami isteri itu turut berkongsi kepada BERITAMediacorp bahawa impian untuk menembusi pasaran Kuala Lumpur atau Indonesia sudah lama terpendam sejak mereka bermula menapak di dunia perniagaan pada bulan November 2013.

    “Memang sudah lama kami impikan menembusi pasaran lain dan pada masa yang sama, menyasarkan menjadi antara yang utama di Asia Tenggara,” tambah Encik Ashraf kepada BERITAMediacorp.

    ISTERI JOVIAN MANDAGIE TAWAR BANTUAN

    Fluff Bakery menyatakan terdapat ramai pelanggan mereka di Singapura, juga datang dari negara jiran. Pelanggan-pelanggan itu juga memberi maklum balas yang positif terhadap kek cawan mereka.

    Namun penantian hendak menebarkan sayap ke Malaysia hanya berlaku apabila seorang lagi pasangan suami isteri yang juga pemilik kafe, Double A dari Malaysia, mempelawa Fluff Bakery untuk meneroka peluang di Malaysia.

    Kalau sudah rezeki, takkan ke mana. Mungkin itulah pepatah yang sesuai diberikan Fluff Bakery. Ini kerana sejurus selepas idea Double A itu, seorang lagi usahawan Cik Nina Ismail Sabri yang juga isteri kepada pereka fesyen terkenal Jovian Mandagie melahirkan hasrat yang sama kepada kedua-dua Encik Ashraf dan Cik Syaira.

    Menurut kedua-dua pemilik bersama itu, kedai sementara di Malaysia itu dibuat secara privet kerana mahu mendapatkan maklum balas terhadap produk-produk Fluff Bakery.

    Antara mereka yang hadir semasa pelancaran itu adalah pelakon Alvin Chong, usahawan fesyen, Vivy Yusof, dan penulis-penulis blog di Malaysia.

    KEDAI DI KL AKAN BERBEZA DARIPADA DI S’PURA

    Walaupun bimbang andainya langkah itu terhenti separuh jalan, Fluff Bakery berkongsi kepada BERITAMediacorp bahawa masanya sudah tepat bagi mereka berdepan dengan cabaran baru supaya ‘tidak rasa selesa’.

    “Di Singapura, kami sudah stabil. Dan kami berterima kasih kepada masyarakat kita yang sering menyokong perjalanan kami sejauh ini. Tetapi masanya sudah tiba untuk kami berdua ingin melihat berapa jauh ‘bayi kesayangan’ kami boleh pergi,” menurut Syaira dan Ashraf.

    Dengan bantuan daripada rakan-rakan niaga di Malaysia, Fluff Bakery berharap rancangannya dapat berjalan dengan lancar. Apatah lagi, pesaing-pesaing dalam industri makanan di Malaysia memang hebat.

    “Kami seronok dengan perjalanan kami sejauh ini dan tidak sabar untuk fasa seterusnya. Memang banyak cabaran yang akan kami hadapi. Yang utama sekali, kami tidak ada kelebihan dari segi pengikut kedai kami berbanding di Singapura,” ujar Encik Ashraf.

    Kedai tetap yang bakal diadakan nanti di Kuala Lumpur juga berbeza daripada kedainya di Singapura. Di Kuala Lumpur, Fluff Bakery akan mengetengahkan kedai di mana para pelanggan dapat membeli dan menjamu selera di kedai itu sendiri.

    “Isteri saya dan kakitangan kami akan menjalankan latihan untuk bakal pekerja kami di sana dan kami membuat kajian dan mendapatkan nasihat daripada rakan-rakan di sana mengenai selok-belok menjalankan perniagaan di Malaysia,” tambah Encik Ashraf kepada BERITAMediacorp.

    APA RAHSIA SEBENAR FLUFF BAKERY?

    Daripada sekadar mengambil tempahan, kepada ‘bersinggah di kedai orang’. Kemudian memiliki kedai sendiri dan akhirnya impian hampir menjadi kenyataan untuk membuka sebuah kedai tetap di Kuala Lumpur. Apakah sebenarnya rahsia Fluff Bakery?

    Encik Ashraf tersenyum dan mendedahkan bahawa resepi atau senjata rahsia Fluff Bakery adalah… isterinya, Cik Syaira.

    “Beliau bukan saja berbakat tetapi juga mempunyai minat yang mendalam apabila timbul perihal membuat kek ini. Beliau tidak penat menukar dan mencari resepi dan kepelbagaian bagi produk-produk kami demi para pelanggan,” kata Encik Ashraf.

    Cik Syaira pula berkongsi kepada BERITAMediacorp bahawa menjaga dan mempertahankan jenama Fluff Bakery itu juga antara perkara yang membuat Fluff Bakery berjaya.

    “Sudah tentu suami saya banyak tolong dalam isu pentadbiran. Kalau harapkan saya, dah pengsan jadinya!” seloroh Cik Syaira.
