    Implementation Of Hudud Law Places Kelantan At Risk Of Being Overrun By Paedophiles

    Paedophiles will overrun Kelantan if it implements hudud as the Islamic law is open to abuse and rejects using scientific evidence to prove crime, says a spokesperson for the group of eminent Malays, or G25.

    Datuk Noor Farida Ariffin said since it would be difficult to prove crimes like adultery, rape of children and adults will abound.

    “This is the nature of PAS’s hudud,” she said.

    Farida said Kelantan’s hudud rejected the use of scientific methods such as DNA testing and fingerprints, instead requiring the evidence of four witnesses of the alleged crime.

    “They are using evidence used in the 12th century to prove adultery, pushing out scientific methods.

    “They are asserting that is the only way to prove the crime of adultery, which does not make sense,” she said, adding that PAS leaders travelled in cars and planes but did not want to accept scientific evidence.

    She added that Prophet Muhammad had also told his people about the importance of acquiring knowledge.

    “The Prophet said that we should go in search of knowledge even up to China.

    “If hudud is implemented in Kelantan, paedophiles will abound in the state,” she said.

    Farida added that the structure of society was not suitable for the implementation of hudud.

    She said Islamic scholars were of the view that many conditions needed to be fulfilled before the Islamic law can be introduced.

    “We need a just society, a smaller gap between the rich and the poor. But here, even among the Malays, there is a divide.

    “The problem is that the ustaz in the villages are spreading the message that hudud is God’s law which cannot be questioned,” she said at a forum on economic freedom and globalisation today.

    The forum was organised by think tank Institute for Democracy and Economic Affairs.

    PAS’s plan to implement hudud in Kelantan has been strongly opposed by its Pakatan Rakyat coalition partner DAP.

    Opposition leader Datuk Seri Anwar Ibrahim yesterday urged PAS to table the proposed amendments to the Shariah Criminal Code Enactment 11 at the Pakatan presidential council meeting tomorrow before taking it to Parliament.

    But Kelantan Menteri Besar Datuk Ahmad Yakob responded by saying that the Islamic enactment could only be tabled at the state assembly sitting or Parliament as it is under embargo.

    “However, we have discussed at the technical committee state, which included legal experts, lecturers and NGOs including parties within Pakatan.

    “So this Sunday, we cannot table the enactment, the next stop is Parliament,” he said after the Friday sermon in Kota Baru.

    Sisters In Islam: Malaysia Not A Theocratic Dictatorship

    KUALA LUMPUR, Nov 10 — Women’s advocacy group Sisters in Islam (SIS) has told minister Datuk Seri Jamil Khir Baharom that Malaysia is a democracy and not a theocratic dictatorship.

    The Muslim women’s rights NGO also said shariah laws are man-made and therefore not infallible, pointing out that the recent court challenges by SIS against a fatwa and by a group of Muslim transgender men against a state shariah law prohibiting cross-dressing were challenges to the “unjust and inefficient” Islamic legal system in Malaysia.

    “We would like to remind the minister that Malaysia is a democratic country, not a theocratic dictatorship,” Datin Paduka Marina Mahathir, a member of SIS’ board of directors, told Malay Mail Online.

    “Our Federal Constitution guarantees the fundamental liberties of every citizen including Muslims. The rule of law applies to everyone, and everyone has a right to seek redress in the courts if they feel they have been unfairly treated,” she added.

    SIS also expressed alarm at the call by Jamil Khir, who is the minister in the Prime Minister’s Department in charge of Islamic affairs, for all Muslims to defend their faith from liberal ideologies “by any method”.

    “Does this mean he is giving the go-ahead for anyone to take vigilante action against those the minister deems un-Islamic, including violence? Does this mean that should anyone physically attack such persons, the state will take no action against them?” Marina asked.

    Jamil Khir said yesterday that in a “new wave” of assault, Muslim transgenders and SIS are colluding with Islam’s enemies to put its religious institutions on trial in a secular court.

    The minister was responding to two recent court challenges where state Islamic authorities were cast into a defensive role, with one initiated by SIS at the High Court here against a Selangor religious edict, or fatwa, declaring their organisation and its members “deviants”.

    The other was a separate case mounted by a group of transgender men who were convicted of cross-dressing under the Negri Sembilan state shariah law, which they won at the Court of Appeal Friday.

    A three-judge panel at the Court of Appeal had unanimously ruled Section 66 of the Negri Sembilan Syariah Criminal Enactment 1992 to be unconstitutional as it violated the three Muslim men’s right to freedom of expression.

    Jamil Khir said Islamic institutions like the state Islamic councils must work together to face “this new wave against Islam”, claiming that there is an “agenda” outside the country’s predominant religion aiming to twist the faith of Muslims.

    Malaysia’s religious authorities have long derided liberalism and pluralism, with Friday sermons nationwide claiming a conspiracy by “enemies of Islam” to manipulate Muslims through ideas like secularism, socialism, feminism and positivism, in addition to the two.

    Bolehkah isteri menuntut cerai daripada suami yang dijatuhi hukuman penjara lima tahun? Apakah keluarga suami wajib menanggung nafkah isteri jika dia berhasrat menunggu suami dibebaskan dari penjara? Bolehkah isteri menuntut nafkahnya yang tertunggak selama lima tahun itu apabila suami bebas dari penjara?

    Isteri boleh menuntut cerai daripada suami yang dihukum penjara. Tuntutan ini boleh dibuat dengan membuat pendaftaran di Mahkamah Syariah (Akta Pentadbiran Hukum Islam (Amla), Seksyen 47 (1)).

    Perceraian boleh berlaku melalui salah satu daripada empat a cara ini: Suami melafazkan cerai setelah melalui perbicaraan di Mahkamah Syariah (Amla, Seksyen 47 (3)).  

    Cerai secara khuluk, iaitu isteri membayar sejumlah wang kepada suami untuk diceraikan. Cara ini biasanya digunakan apabila suami tidak mahu menceraikan isterinya melalui cara biasa (Amla, Seksyen 47 (4)).  

    Cerai secara taklik apabila Mahkamah Syariah mensabitkan bahawa suami telah gagal menunaikan kewajipan nafkah kepada isteri selama empat bulan berturut-turut (Amla, Seksyen 48 (1), lihat juga lafaz taklik nikah di sijil pernikahan anda).

    Cerai melalui fasakh, iaitu perintah Mahkamah Syariah bagi menceraikan pasangan suami isteri apabila (yang antara lain): i)  suami gagal memberi nafkah kepada isteri selama tiga bulan (Seksyen, 49 (1)(a)) ii)  suami dipenjara tiga tahun ke atas (Seksyen, 49 (1)(b)).

    Jika anda telah tekad membuat tuntutan cerai, sebaik-baiknya anda dapatkan khidmat peguam. Peguam anda akan memberi nasihat lebih terperinci mengenai pilihan dan proses terbaik bagi kes anda. Di sisi agama, kegagalan suami yang dipenjara memenuhi kewajipan nafkah kepada isteri menjadi hutang tertunggak bagi isteri.

    NAFKAH KELUARGA

    Kewajipan memberi nafkah kepada isteri dalam hal ini tidak berpindah kepada keluarga suami, baik dari segi hukum agama mahupun undang-undang. Ertinya, isteri tidak boleh menuntut keluarga suami memberi nafkah kepadanya bagi memenuhi sara hidupnya.

    Namun, menjadi fardu kifayah bagi keluarga isteri dan suami (khususnya bapa dan ibu mentua) membantu memenuhi keperluan hidup isteri selama suami dalam penjara.

    Fardu kifayah di sini bermaksud ia adalah kewajipan kolektif yang jika ada sebahagian ahli keluarga menunaikan kewajipan ini, maka terlepaslah yang lain daripada dosa. Jika tidak, kesemuanya bakal dipertanggungjawabkan oleh Allah.

    Satu langkah yang lebih praktikal bagi isteri yang berada dalam situasi ini ialah mendapatkan bantuan kebajikan daripada badan Islam yang menawarkan pelbagai bantuan sosial kepada keluarga yang mempunyai masalah kewangan, termasuk kepada isteri yang suaminya berada dalam penjara.

    Jika anda ingin menuntut hak nafkah tertunggak daripada suami selama tempoh beliau dipenjara, anda dinasihatkan membuat tuntutan nafkah berkenaan daripada Mahkamah Keluarga kerana dengan mendapatkan perintah mahkamah, hak anda lebih terpelihara dan mudah dikuatkuasakan, jika suami enggan memenuhinya setelah dibebaskan. Anda boleh melakukan ini tanpa perlu menunggu suami keluar dari penjara.

    Tanpa perintah mahkamah, pembayaran nafkah tertunggak akan bergantung pada persetujuan anda dan suami semata-mata.

  • Workers’ Party: Set Up Committee to Address Malay-Muslim Concerns

    SINGAPORE – Mr Muhamad Faisal Abdul Manap of the Workers’ Party yesterday called for the formation of a committee to address concerns of Malay-Muslims over how their loyalty to the nation is viewed.

    But in a swift rebuttal, Senior Parliamentary Secretary for Education and Manpower Hawazi Daipi deemed his suggestion unnecessary as this was an issue that could be overcome by strengthening inter-racial ties.

    The exchange began with Mr Faisal saying that more needed to be done to “address and find solutions” to community concerns highlighted in a recent report. He quoted the findings of the Suara Musyawarah committee, which said Malay-Muslim participants felt left out in certain policies and practices which “question the loyalty of Malays to the country”.

    The committee was formed in 2012 to gather feedback on the thoughts, concerns and aspirations of Malay-Muslims. Its report highlighted personal accounts of employers expressing a preference for non-Malay workers and surfaced concerns over exclusion from certain parts of the Singapore Armed Forces.

    Mr Faisal acknowledged that progress has been made in terms of opportunities afforded to Malay-Muslims in education and national service, but said the committee’s formation could offer a “quick solution” to achieving a “more inclusive and open Singapore society”.

    Responding to his speech, Mr Hawazi and Mr Zainal Sapari (Pasir Ris-Punggol GRC) later asked Mr Faisal if the latter had ever felt that his loyalty to the country was questioned, and what his own views on the issue were.

    “I’m concerned (that) if we highlight the differences, we will be widening (them) not only among one community but all communities,” said Mr Hawazi, adding that schools and community activities are means to forge greater social cohesion.

    In response, Mr Faisal stressed that the issue of loyalty among Malays was surfaced by the Suara Musyawarah report, and not him.

    Mr Hawazi then suggested that Mr Faisal had cherry-picked portions of the report, failing to highlight, for example, that Malay-Muslim participants also said they were “very committed” to Singapore on issues that include defence and security.

    Maintaining that he was reflecting concerns on the ground, Mr Faisal said: “I have said in my view that I am aware and agree there is progress made, but because there are still many people who say that this issue is present, I, as a voice of the people, would like to voice it out.”

  • Brunei’s Syariah Penal Code Order Starts 1 May 2014

    HIS Majesty The Sultan and Yang Di-Pertuan of Brunei Darussalam today announced that the enforcement of phase one of the Syariah Penal Code Order in Brunei will commence with effect from tomorrow, May 1, 2014.

    The first phase of the Order covers general offences set by the state, including disrespecting the month of Ramadhan and not performing Friday prayers. General offences are punishable by fines, imprisonment or both.

    Corporal punishment such as whipping and amputation of limbs for crimes such as theft will not be enforced until the second phase. The death penalty will come into force in the third phase.
