    District Judge: National Servicemen Do Not Need To Follow Illegal Or Unlawful Orders

    A former full-time national serviceman (NSF) who was driving a military jeep without a licence when it crashed and killed his close friend was sentenced to a 10-day short detention order (SDO) yesterday.

    Cavin Tan, 22, had no Class 3 driving licence when he caused the death of NSF Tan Mou Sheng and caused hurt to NSFs Ow Yong Wei Long and Dickson Hong, who were all 20 then, at the Singapore Armed Forces (SAF) Marsiling training area in Mandai 21/2 years ago. He pleaded guilty to both charges.

    It also emerged that he had been ordered to drive the jeep.

    District Judge Low Wee Ping said: “Perhaps one positive outcome of this case is that national servicemen now know that they do not need to obey a manifestly illegal or unlawful order.”

    He asked Tan’s lawyer Laurence Goh, a senior officer in the SAF, to get the message out that national servicemen need not obey any such order.

    Deputy Public Prosecutor Tang Shangjun said the four men – all instructors – were involved in a training exercise led by Master Sergeant Lee Kong Kean. The 33-year-old has been charged and his case is pending.

    The Defence Ministry said that it does “not condone our commanders giving unlawful orders, and those who do so will be seriously disciplined”.

    Tan was told by Lee to drive one of the jeeps in the exercise even though he had no Class 3 military licence and had not been trained to drive one.

    On the morning of the accident, Tan lost control of his jeep while negotiating a downward slope with a left bend.

    DPP Tang said Tan misjudged the bend and made a sudden, sharp turn. The jeep tilted, rotated around and overturned several times before landing on its side.

    NSF Hong and NSF Ow Yong, who had not been wearing seat belts or helmets, were thrown out and injured. Tan unbuckled himself and found NSF Tan Mou Sheng pinned under the jeep at his left hip. He was bleeding from his nose and mouth and soon lapsed into unconsciousness. The soldiers managed to lift the jeep and pull him out. He died later from severe pelvic crush injuries.

    Mr Goh said in mitigation that Tan, now an undergraduate, obeyed the order to drive even when Lee had been told that he did not have a Class 3 licence. Tan, he said, was truly sorry for having caused the death of his college mate.

    He urged the court to give his client a second chance by imposing the SDO, a community-based sentence which came into place in 2011. These can last up to 14 days and are less disruptive and stigmatising than a jail sentence.

    Said Mr Goh: “The accused’s decision to drive the jeep not only went against good sense, but also constituted serious breaches of SAF military training safety protocols.”

    Judge Low urged Tan to put this behind him and look forward.

    NSF Tan Mou Sheng’s father told Tan and his parents that Tan was not at fault because he was just obeying orders. Both fathers shook hands outside the court.

    TATKALA kebanyakan wanita ditemani suami tersayang saat melahirkan anak, Cik Siti Mariam Ishak terpaksa bertarung nyawa sendirian tanpa suami di sisi.

    Sedang ibu lain menangis gembira menyambut kelahiran anak mereka, beliau pula mencurahkan air mata duka.

    Cik Mariam, 29 tahun, pilu mengenangkan nasib beliau kehilangan suami ketika sarat mengandung dan kini cahaya mata mereka tidak dapat bertemu ayahnya sejurus lahir ke dunia. Suaminya, Allahyarham Muhammad Afiq Abdul Rahim, 26 tahun, meninggal dunia dalam satu kemalangan motosikal Mei lalu.

    Ketika itu, Cik Mariam mengandung sekitar lima bulan. Kehadiran bayinya, Nur Fiq’ Arianna Muhammad Afiq, bak pembakar semangat bagi beliau meneruskan kehidupan seperti biasa. Menurut Cik Mariam, wajah Nur Fiq’ mirip ayahnya. “Mukanya, bentuk bulatnya, rambutnya, sebiji macam bapanya,” ujar beliau.

    Bahkan, nama bayinya, Nur Fiq’ Arianna, kombinasi nama arwah suaminya dan nama timangan Cik Mariam.

    Cik Mariam melahirkan Nur Fiq’ pada 12 September – sekitar lima bulan selepas suami beliau meninggal dunia.

    “Saya menangis teringatkan suami saya. Saya ingin sangat beliau berada di sisi saya, seperti bapa dan suami lain (saat kelahiran anak),” kata beliau yang kini reda dengan pemergian suaminya dan berasa lebih tenang.

    Kelahiran anak ketiga Cik Mariam di Hospital Wanita dan Kanak-Kanak KK (KKH) pada 2.47 pagi itu disambut bersama ibunya.

    Cik Mariam mempunyai dua lagi anak perempuan berusia lapan dan sembilan tahun hasil perkahwinannya yang pertama.

    Menurut Cik Mariam, ibu mentuanya telah berhenti bertugas selepas anaknya meninggal dunia agar dapat membantu beliau menjaga anak-anaknya.

    Ibu kandungnya juga kerap datang membantu. Mengenai kes kemalangan suaminya, Cik Mariam berkata polis telah pun menemui seorang saksi yang mempunyai rakaman video kemalangan itu dan telah memberinya peluang melihat video itu sebelum Hari Raya lalu.

    Katanya video itu menunjukkan sebuah kereta melanggar Allahyarham dari sebelah tepi, menyebabkan suaminya terjatuh.

    “Saya tidak marah tapi keadilan harus ada. Cara dia pergi satu kejutan,” kata beliau. Kemalangan tersebut berlaku di antara motosikal dengan bas di BKE ke arah Woodlands pada pagi 5 Mei lalu.

    Ia masih disiasat polis. Memandang ke hadapan, Cik Mariam merancang untuk memulakan semula perniagaan dalam talian membuat pastri, kuih dan kek di laman Facebook pada tahun depan.

    Cik Mariam juga memberitahu bahawa beliau bakal berpindah ke flat Bina Ikut Tempahan (BTO) empat bilik di Yishun yang dimiliki bersama kakaknya dalam masa tiga tahun.

    Flat itu pada awalnya telah ditempah bersama suaminya. Beliau mengucapkan terima kasih kepada semua yang membantunya sejak pemergian suaminya.

    “Motivasi terbesar saya sekarang adalah ‘si kecil’ ini. Kehidupannya sedikit berbeza dan saya akan timba pengalaman baru dengan ‘si kecil’.

    Saya akan melakukan dengan terbaik dalam kehidupan,” kata beliau.

    Boy Injured After a Glass Door at Westgate Mall Fell on Top of Him

    A four-year-old boy suffered a cut to the back of his head and neck pains, after a glass door on level 5 of the mall reportedly “detached itself” and fell on top of him.

    A member of the public who only wants to be known as “Paul” sent in photos of the aftermath. He says he heard from the boy’s mother that the glass door – about three-metres high – just outside of NTUC’s My First Skool childcare centre and a Fitness First gym, leading to the outdoor area on Level 5, detached and fell on top of the boy just before 6pm.

    Mr Paul says the boy’s entire body was pinned down by the door, and that he was lying facedown when he arrived shortly after. The boy’s right cheek appeared to be bruised. There were also traces of blood on the ground.

    “Because the glass door is tempered glass, it shattered within,” said Mr Paul. He says two staff members from the nearby Westgate Kids Club brought a first aid kit to tend to the boy, and a doctor from a clinic one level down came up to assist as well.

    The Singapore Civil Defence Force (SCDF) confirms it received a call on the incident at 6:05pm, and says the boy suffered a cut to the back of his head and reported having neck pains.

    He was sent conscious to the National University Hospital, accompanied by his mother and mall staff.

    A spokesperson for Westgate mall says the boy was swinging the glass door the time of the accident. “Our investigations revealed that the boy had over-extended the glass door when he swung it, causing it to hit the door frame and shatter,” said Ms Mandy Chiu, the marketing communications manager for Westgate in a statement to Channel NewsAsia.

    The boy remains in hospital for observation, but is in stable condition. “We wish him a speedy recovery, and continue to extend our help to him and his family,” said Ms Chiu.

    The mall’s contractor will be conducting safety checks on its glass doors and panels overnight, to prevent a recurrence of such an incident.
