  • Indonesia’s First Islamic Transgender School Opens in Yogyakarta

    An Islamic transgender boarding school has been reopened in the city of Yogyakarta on the Indonesian island of Java, it’s reported.

    The school, known locally as a Pesantren Waria, was the first of its kind in the country and first opened its doors in 2008 but closed when its founder died last month. It has now moved to a house belonging to Shinta Ratri, a lesbian, gay, bisexual and transgender (LGBT) activist.

    The 35 students learn Islamic studies, and have a chance to work and earn money, The Jakarta Post newspaper reported. Previously, the school had a beauty salon and also hired out traditional wedding dresses.

    “According to the Koran, we are not allowed to classify people based on economic, social, political, gender or theological values,” Abdul Muhaimin, a leader of Indonesia’s Brotherhood Forum of the Faithful, an organisation that encourages religious tolerance, said at the opening ceremony. “I hope the students here are strong as they must face stigma in society.”

    The Jakarta Globe has reported elsewhere that public opinion in Indonesia is strongly opposed to LGBT rights. It quotes the 2013 Global Divide on Homosexuality study by the Pew Research Center, which says 93% of people asked thought gay people should not be accepted.

  • Malaysian Politicians are Blinded and In Denial

    OUTSPOKEN: A very wise old man a long time ago had told the story about a shoal of swordfish that had attacked Singapore. The ruler of the day ordered the people to line up by the shore and asked them to offer their legs for the swordfish to ram through and they could then kill the fish while they were still dangling from their legs.

    A young boy, however, told the people that they should instead go and cut banana trees and stick them along the shore so that the fish would poke through these trunks and the people could then easily slaughter them.

    The people followed the boy’s advice and were happy that nobody got hurt and there was plenty of fish to eat. The boy’s brilliant idea caused the ruler to be very angry and disturbed. The boy was too clever for his own good and he had him killed. This anecdote has of course entered into Malay folklore under “Singapura dilanngar todak” (Swordfish attack on Singapore).

    The narrator had to remain anonymous as during that period of time, stories told must only glorify the ruler. Stories must be told how brave he was and how full of mysticism his character was. No one else must surpass his standing, be it the mind or the might of his power.

    Today Umno Baru is suffering from this very same syndrome. No member should be cleverer than the leader. Thus Khairy Jamaluddin, the Oxford educated head of Umno Youth, had to act stupid so as not to offend the leadership. Forthright personalities who could not pretend to be stupid to accommodate the lack of intellectual culture of the leadership would simply be passed by like Datuk Saifuddin Abdullah, the former Temerloh MP and a liberal. The party must simply be happy that he lost in the 13th general election.

    Today, we witness the result of this cultural trait.

    The loss of MH370 had brought out the most bizarre array of contradictions ever displayed by any group supposedly responsible for the investigation into this loss. The Inspector General of Police contradicted the Director General of the Department of Civil Aviation and also that of Malaysia Airlines.

  • MUIS Advisory on Multi-Level Marketing

    Background

    1. Muis is currently monitoring the emerging concerns on commercial transactions in the form of multi-level marketing (hereupon MLM), specifically within the Singapore context. We have also received questions on the Islamic position on such transactions.

    Islamic Position on Multi-level Marketing

    1. In addressing this issue, Muis refers to our scholarly traditions in laying down the general guidelines for all MLM transactions. Muslims who would like to participate in MLM transactions should ensure that such transactions adhere to the following elements:
      i) Participants must participate willingly, and are not coerced or pressured into becoming a member or an agent.The Prophet (s.a.w) stated in a hadith: It is unlawful to benefit from a property of a Muslim, except on the basis of willingness (Al-Baihaqi).
      ii) Transactions must include products that are of tangible and inherent value, and which the product benefits are independent from the MLM scheme. The price paid should thus be appropriate for the products transacted, and not something one would normally not buy at that price. In Islam, transactions which involve products that have no tangible value are considered Bay’ Gharar or ambiguous transactions.
      iii) Products involved should also be permissible from the legal and Islamic aspects (halal). The Prophet (s.a.w) said; If Allah makes something unlawful, He makes its sale unlawful (Abu Dawud).
      iv) Bonuses and incentives received by all parties involved in the scheme should be made known and agreed upon by all members and agents.The Prophet (s.a.w) has also exhorted Muslims to strictly adhere to truthfulness in business transactions. “…and if both the parties spoke the truth and described the defects and qualities [of the goods], then they would be blessed in their transaction, and if they told lies or hid something, then the blessings of their transaction would be lost (Bukhari).Hence all conditions pertaining to a transaction must be clearly specified and clarified upfront.
    2. Muslims should also be cautious of the following:
      i) Schemes that involve promising its members payment or services primarily through enrolling other people into the schemes, rather than supplying any real investment or sale of products or services.
      ii) Schemes that will collapse in the long-run, hence causing later participants to lose their upfront payments. Those who are most vulnerable are those towards the bottom of the pyramid, where it becomes nearly impossible to recruit new members required to pay off the previous layer of recruiters.
      iii) There is a compulsory purchase of goods and services, or required investment whether in the form of a joining fee or buying inventory, as a requirement before one is entitled to the bonuses and benefits offered in the scheme.
      iv) Elements of manipulation, exploitation, injustice, unfairness and deceit.
      v) Elements that contradict what have been underscored in the shari’ah with regard to commercial transactions.

    Legal Prohibition

    1. In Singapore, the Ministry of Trade and Industry administers the Multi-Level Marketing and Pyramid Selling (Prohibition) Act. Any MLM activities will thus be governed by this Act. The products offered will also be subjected to all prevailing laws of Singapore. There are exclusions to this Act, and they are captured in the revised Multi-Level Marketing and Pyramid Selling (Excluded Schemes and Arrangements) Order.

    Conclusion

    1. Muis would thus like to advise Muslims who are considering participating in any investment schemes to be cautious and to observe the abovementioned guidelines. They should also ensure that they do not contradict any religious principles or the law of the land prior to joining any schemes.

  • Pemimpin DAP Karpal Singh Meninggal Dunia

    KAMPAR (PERAK): Anggota Parlimen (AP) Bukit Gelugor dan pemimpin pembangkang veteren DAP, Karpal Singh, meninggal dunia selepas terlibat dalam satu kemalangan trafik dekat Gua Tempurung, awal pagi tadi, Khamis.

    Encik Karpal, seorang peguam, dan pembantunya, C Michael, meninggal dunia di tempat kejadian, lapor akhbar The Star Online.

    Anak lelaki beliau, Ramkarpal dan pemandu kereta terbabit, C Selvam, cedera dalam kejadian sekitar 1 pagi itu.

    Mereka kemudian telah dikejarkan ke Hospital Kampar.

    Kereta yang dinaiki Encik Karpal dan tiga yang lain telah bertembung dengan sebuah lori.

    Beliau dikatakan sedang menuju ke Pulau Pinang untuk menghadiri satu kes mahkamah.

    Ahli Parlimen Bukit Gelugor, Karpal Singh, semasa hidupnya dikenali sebagai pemimpin pembangkang yang lantang dan seorang peguam digeruni.

    Karpal mendapat ijazah perundangan dari Universiti Singapura dan berkhidmat sebagai peguam sebelum mula menyertai politik setelah menjadi ahli DAP pada tahun 1970.

    Bekas Pengerusi DAP itu kemudiannya bertanding kerusi parlimen pada tahun 1978 serta pernah meyandang Naib Pengerusi DAP dan Timbalan Pengerusi DAP.

    Karpal, 74, yang aktif berpolitik selama 36 tahun turut digelar ‘harimau jelutong’ kerana kesukarannya untuk ditewaskan dalam pertandingan kerusi Parlimen Jelutong sebelum pilihanraya umum pada 1999.

    Dikenali sebagai seorang yang pandai berhujah, beliau pernah dilantik menjadi peguam Datuk Seri Anwar Ibrahim untuk kes liwatnya itu.

    Karpal berkahwin dengan Gurmit Kaur dan dikurniakan lima anak.

    Salah seorang anaknya,Gobind Singh Deo merupakan Ahli Parlimen Puchong setelah menang di dalam Pilihan Raya Umum ke-12 pada 2008.

    Karpal juga pernah dipenjarakan di bawah Akta Keselamatan Dalam Negeri (ISA) pada tahun 1987 dalam Operasi Lalang.

    Pada Mac, Karpal melepaskan jawatan Pengerusi DAP sementara menunggu rayuan kes hasutan yang dikenakan terhadapnya selesai.

    Pada 2005, Karpal turut terlibat dalam satu kemalangan jalan raya yang menyebabkan beliau lumpuh dan sejak itu menggunakan kerusi roda.

  • Anwar Ibrahim Lambasted Singapore for Supporting Malaysia

    He described Singapore as “sometimes inconsistent” with its own belief, saying that the country had often championed meritocracy but would settle for “mediocrity” in terms of what was taking place in neighbouring countries including Malaysia.

    “We the opposition are not totally against the initiative taken by the Malaysian government, but we question the lack of transparency.

    “And Singapore should not infer us the opposition as being irresponsible in its criticism.”
